Auto Rental Agreement Terms

This Auto Rental Agreement ("Agreement") is entered into between Sitka Sound Auto Rental ("Owner") and the renter ("Renter") (collectively, "Parties"). For good and valuable consideration, the Parties agree as follows:

Renter Warranties

Renter warrants that he or she is physically and legally qualified to operate the Vehicle. Renter further agrees that:

• Renter is age 25 or over and agrees to provide Owner a copy of State issued drivers license
• The Vehicle will not be used to carry passengers or property for hire
• No occupant or operator of the Vehicle will use the Vehicle in any way other than permitted by law
• The Vehicle will not be used to engage in any racing or other competition
• Renter will not operate the Vehicle negligently, under the influence of any substance, or in a way that puts any person, including Renter, in danger
• Renter will not allow any other person to operate the Vehicle unless seeking and receiving prior written permission from Owner

Insurance Requirements

The Renter agrees to provide proof of insurance covering personal injury to Renter, to the rental vehicle, rental vehicle passengers and other persons and/or property. The state of Alaska minimum coverages will apply:

• Bodily injury liability $50,000 per person and $100,000 per accident
• Property damage liability $25,000 per accident
• Uninsured/underinsured motorist bodily injury $50,000 per person and $100,000 per accident
• Uninsured/underinsured motorist property damage $25,000

Traffic Violations

All traffic or parking penalties are Renter's responsibility, and Owner may charge the Renter's credit card for any fines or fees incurred by the Renter.

Indemnification

Renter is liable for, and must indemnify Owner for, any loss of, or damage to, the Vehicle and its accessories; any consequential damage, loss, or costs incurred by Renter, including salvage costs, loss of ability to re-hire and loss of revenue; and any loss of or damage to the Vehicle or property of third parties, arising during the Rental Period.

Jurisdiction

This Agreement will be construed in accordance with and governed by the law of the State of Alaska. Any action arising from this Agreement must be brought in a Sitka City & Borough County court.
